General provisions
1. The website www.juodupesdarzelis.lt (hereinafter – the Website) rules of use and privacy policy (hereinafter – the Rules) set out the terms and procedure for using the Website and the main principles of the collection, processing and storage of personal data on the basis of which the Website controller – Rokiškis District Juodupė Nursery-Kindergarten, legal entity code 290228030, registered office address Tekstilininkų g. 5 LT-42467, Juodupė town, Rokiškis District Municipality, Lithuania (hereinafter – the Institution), processes the personal data of Website visitors (hereinafter – the User).
2. By entering the Website, Users confirm that they unconditionally agree to these Rules and undertake to comply with them. The Rules apply both when the Website is used by a User who has logged in and to Users who have not completed the login procedure. By logging in to the Website and/or using it, Users confirm that they have duly familiarised themselves with the Rules and agree that the Institution will process the information provided by Users (including personal data) to the extent necessary to manage the Website and ensure its functioning and to provide the Website services.
3. The Website services are services related to informing clients and the submission of client information (hereinafter – the Website services), which include:
3.1. the provision of information about the Supplier's services and the amounts payable by the client;
3.2. the submission of questions or other information and/or the ordering of services by electronic means.
3.3. any other services provided via the Website.
4. The Institution has the right to amend the Rules unilaterally by announcing this on the Website. Amendments to the Rules enter into force on the day they are published on the Website. If the User continues to use the Website services after the Rules have been amended or supplemented, the User is deemed to agree to the new version of the Rules.
User login and personal data protection
5. The Website may be used, or used to its full extent, only after the correct login details have been entered on the Website. Login is performed by clicking the active link “Prisijungti” (“Log in”) on the right-hand side of the Website, having first filled in the username and password. By logging in to the Website, the User confirms that:
5.1. the User has read these Rules attentively and carefully, has understood them and agrees to them of their own free will, and undertakes to use the Website in accordance with the procedure and conditions laid down in the Rules;
5.2. the data provided by the User are correct, accurate and complete. When changing or filling in data about themselves, the User must provide only correct data. Any losses arising from the provision of incorrect data shall be borne by the User;
5.3. if the User's data or other related information changes, the User undertakes to change (supplement) their data on the Website immediately, but no later than within 7 (seven) working days;
5.4. the User agrees that the Institution may process any personal data and/or other information provided by the User and use them for the purposes of implementing these Rules, providing the Institution's services, direct marketing (if the User's consent has been obtained) and for other purposes.
6. The User is prohibited from assuming the identity of other persons by stating another person's name, surname and/or other data. The Institution has the right, immediately and without prior notice, to prohibit a User who disregards these requirements from using the Website. Where there are reasonable suspicions that by such actions the User has caused or could have caused damage to the Institution and/or third parties and/or the public interest, the Institution has the right to transfer all the data it holds about such a User to state institutions.
7. The User unconditionally undertakes to ensure the confidentiality of the data provided and must make every effort to protect the Website login password from becoming known to third parties, not to disclose it to third parties by any direct (indirect) means, and to ensure that no third parties are able to use the User's data when using the Website or logging in to it.
8. The personal data provided by the User on the Website are processed by the Institution in compliance with these Rules, the requirements laid down by the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts of the Republic of Lithuania governing the processing and protection of personal data.
9. The personal data provided by the User by filling in electronic forms (name, surname, e-mail address, telephone number, address, etc.) are used for the following purposes:
9.1. For the purposes of providing the Website's and the Institution's services.
10. The User, by contacting the Institution in writing by e-mail at juodupesdarzelis@gmail.com , or by visiting the customer service centre and presenting an identity document to the Institution, has the right:
10.1.to apply to the Institution with a request to provide information about the User's personal data processed by the Institution;
10.2. to apply to the Institution with a request to rectify the User's personal data and/or suspend the processing of such personal data, except for storage – where, having accessed the personal data, the User establishes that the data are incorrect, incomplete or inaccurate;
10.3. to apply to the Institution with a request to destroy the personal data or suspend the processing of such personal data, except for storage – where, having accessed their personal data, the User establishes that the personal data are being processed unlawfully or unfairly;
10.4. to object to the processing of the User's personal data where these data are processed or are intended to be processed for direct marketing purposes.
11. Personal data must be accurate, adequate and only of the scope necessary for their collection and further processing. Where necessary for the processing of personal data, the personal data are kept up to date.
12. The Institution undertakes not to disclose the User's personal data to other third parties, except for the Institution's partners providing services related to the services provided by the Institution. In all other cases, the User's personal data may be disclosed to third parties only in accordance with the procedure laid down by the legal acts of the Republic of Lithuania.
Rights and obligations of the Institution and the User
13. The Institution reserves the right, at any time and without notifying the User, to change the Services provided by the Institution as indicated on the Website or individual conditions thereof.
14. In order to defend the rights and legitimate interests of persons and/or in complying with the requirements of legal acts, and/or where the User fails to comply with the provisions of these Rules, the Institution has the right to cancel the User's registration on the Website without prior notice or the User's consent.
15. The Institution has the right, at any time and without prior warning, to suspend or completely terminate the operation of the Website.
15. When using the Website and/or the Services provided by the Institution, the User must:
15.1. strictly comply with the procedure and requirements laid down in these Rules;
15.2. not infringe the rights and legitimate interests of the Institution and third parties;
15.3. not provide false and/or misleading data about themselves or other incorrect information;
15.4. use only secure means and devices for electronic communications and data transmission;
15.5. not spread computer viruses and/or take other measures that could disrupt the operation of the Website, damage or destroy information, or cause other harm to the Website or to the process of providing the Institution's services;
15.6. not take any intentional actions that would disrupt the operation of the Website and the provision of the Website's or the Institution's services to the User or third parties;
15.7. respect and not violate the established and socially recognised norms of conduct and morality, the rights and legitimate interests of third parties and the requirements of legal acts;
15.8. immediately inform the Institution if it becomes known to them that their Website login details are being used or may be used by other third parties.
16. If the User breaches any of the provisions of these Rules, the Institution acquires the right, at any time, to restrict fully or partially the User's ability to use the Website in any way.
Protection of intellectual property and links to other websites
17. All rights to the Website and the works contained in it are protected by the laws and other legal acts of the Republic of Lithuania. It is strictly prohibited to copy texts, photographs, logos, banners and all other design elements with the aim of using them for commercial purposes or for other purposes that infringe the rights and legitimate interests of the Institution or third parties.
18. All trademarks presented on the Website are the property of the Institution, or the Institution uses them lawfully on the basis of agreements concluded with their owners.
19. This Website may contain links to other websites which will allow the User to leave this Website in order to obtain third-party information, or third-party information may be presented on this Website.
20. The Institution cannot change, update or control the content of such websites and therefore assumes no responsibility for the accuracy of the content presented on them.
21. The User should note that other websites to which this Website directs may be subject to website rules of use, a privacy policy, confidentiality provisions, personal data processing provisions and other provisions that differ from those applicable on the Website.
Ordering services on the Website
22. By using the Website, Users may order the services of the Institution and/or third parties or submit enquiries regarding the ordering of such services.
23. When ordering the services of the Institution and/or third parties or submitting an enquiry regarding the ordering of such services, the User knows and agrees that the information and data they provide when filling in the enquiry will be transferred to the provider of such services.
24. When ordering the services of the Institution and/or third parties or submitting an enquiry regarding the ordering of such services (by providing their data and/or contact information), the User assumes all responsibility and risk for the use of the data they transfer to third parties.
Cookies
25. In order to make the User's use of the Website faster and more convenient, the Institution uses cookies. A cookie is a small file sent to and installed on the User's computer. The Institution uses the installed information to recognise the User and to monitor Website traffic statistics.
26. The User is able to view in their browser what information (cookies) the Institution installs, and to delete some or all of the installed cookies. By using the Website, the User agrees that the cookies specified by the Institution may be stored on their computer (device). The User may withdraw this consent at any time by changing their internet browser settings; however, in that case certain functions of the Website may not work.
Final provisions
27. The Rules are governed by the law of the Republic of Lithuania. All disagreements arising between the Website and the User shall be resolved by negotiation. If the parties fail to resolve a dispute by negotiation, such dispute shall be finally settled in court in accordance with the procedure laid down by the laws of the Republic of Lithuania.
28. All rights to the Website and the works contained in it are protected by the laws and other legal acts of the Republic of Lithuania. No content on the Website or other textual, graphic or other information may be reproduced, made publicly available or distributed without the prior written consent of the Institution.
